I have been working and living in China for the last 3 and a half years but have still been getting paid by my company in the UK and paying UK tax and national insurance. Am I able to claim any of this back?

It will depend on your tax status.

If you are classified as resident in the UK for UK tax purposes, you will be taxed on your income from both the UK and overseas.

If you become classified as a non-resident, you will normally only be taxable on your income arising in the UK.

Usually if you leave the country to work abroad , you will become non resident if:

1. Your absence and employment from the UK covers a complete tax year.
2. You spend less than 183 days in the UK during the tax year, and
3. Your visits to the UK do not average 91 days or more a tax year over a maximum of 4 years.
